banner Why do I need a Property Report?

We see so many applications that have been refused due to the lack of an Immigration Property Inspection Report at the initial application stage. There is a significant risk that a UK Settlement Visa application will be refused by an Entry Clearance Officer if a property inspection report is not supplied with an initial application to show that the ‘ adequate accommodation’ requirement  has been satisfied under the UK Immigration Rules. Why take such a risk and lose money from expensive application fees and the hard work that has gone into preparing the Visa application when an Independent and Professionally prepared Property Inspection Report was all that was needed.

The huge cost of dealing with a refused application and time spent away from Loved ones can be very stressful but we can help by ensuring that you are fully prepared from the start of your application.

The Home Office have issued a supporting document and information guide which states that a property inspection report is required for all applications that lead to long term residency and settlement.

The Home Office also state that it is the responsibility of the applicant to satisfy the Visa Officer that they have provided the correct documents and although they have provided a guide it is important that as much evidence as possible is given to them to reduce the risk of refusal. You may feel that providing basic accommodation or housing document is enough such as a tenancy agreement but remember it is all part of a bigger puzzle. It is not the UK Visa Officers job to help you with the application and tell you what is needed and how to get it. It is their job to enforce the law and ensure that all UK Visa Applicants have followed the guidance.

Immigration Property Inspection Reports are to be used for UK Visa applications for:

  • Spouses and civil partners
  • Fiancé(e)s and proposed civil partner
  • Unmarried and same-sex partners
  • Children
  • Parents, grandparents and other dependent relatives
  • Family Visitor Applications
  • Further Leave to Remain / Extension applications for Spouses. This is an in country application made in the UK.

The official link to the UK Visas & Immigration website for supporting documents required for all settlement applications can be found by clicking the link below and looking at page 3 of the guide under Accommodation details.

An Immigration property inspection report is the only document in the Home Office supporting documents information guide which demonstrates to the UK Visa Officer that you have

“Obtained an independent assessment of the number of rooms and occupants of the proposed accommodation”

A report from a suitably qualified professional body certifying that a assessment has been carried out and giving details of accommodation inspected is usually acceptable for this purpose. Above all, the Entry Clearance officer must be satisfied that the accommodation will not become overcrowded within the definition of the Housing Act 1985 or that it will not contravene public health regulations”.

Under current Immigration Rules the Visa Officer has to be satisfied that a property inspection report has been obtained from a suitably qualified and independent professional who is accredited to a recognised body to confirm the intended accommodation:

  1. i) Is not statutorily overcrowded under Part X of the Housing Act 1985 and has sufficient space to accommodate both the current occupiers and any additional people who propose to live there, and;
  1. ii) Has been inspected and risked assessed for Category 1 and 2 Hazards to ensure that the accommodation complies with the Housing Health and Safety Rating System (HHSRS) under the provisions of Part 1 of the Housing Act 2004
